General Terms and Conditions of Sale of the site rage-mechanics.com
Version applicable as of September 16, 2026. They replace the general terms and conditions of sale and the refund policy of February 2, 2023.
Article 1. Parties
These general terms and conditions of sale ("GTCS") are concluded between the company SAS Rage Mechanics, a simplified joint-stock company with a capital of €1,000, registered with the Lyon Trade and Companies Register under number 919 621 839, whose registered office is located at 34 rue des Remparts d'Ainay, 69002 Lyon, France, intra-community VAT number FR65919621839, e-mail: contact@rage-mechanics.com, hereinafter "Rage Mechanics" or "the Publisher", and any person placing an order on the site rage-mechanics.com, hereinafter "the Customer".
Article 2. Definitions
- "Customer": any natural or legal person who places an order on the Site. The "consumer" Customer is the natural person who acts for purposes that do not fall within the scope of their professional activity; the "professional" Customer is any other person, in particular resellers with an account in the reseller area.
- "Product": any good or service sold on the Site: vehicles (electric scooters and other devices), spare parts, performance parts, accessories, workshop services.
- "Made-to-order Product": Product not available in stock at the time of the order, sourced, manufactured or assembled after payment validation.
- "Assembled Product": Product resulting from the assembly, by Rage Mechanics and at the Customer's request, of parts on a vehicle or on another part (in particular the "Titanium Edition" packs).
- "Site": the site accessible at the address rage-mechanics.com and its subdomains.
Article 3. Scope and Acceptance
The GTCS apply to any order placed on the Site. They are accessible at any time on the Site and prevail over any other document, in particular over the purchasing conditions of the professional Customer. The Customer declares to have read and accepted them by checking the box provided for this purpose before payment; this acceptance has the same value as a handwritten signature. Rage Mechanics' computer records serve as proof of orders, acceptances and exchanges, unless proven otherwise.
The Customer declares to have the legal capacity to contract. The Products are intended for adults.
The applicable GTCS are those in force on the day of the order. Rage Mechanics may modify them at any time for future orders.
Article 4. Products
The essential characteristics of the Products are presented on each product sheet. Photographs, videos, renderings and technical sheets are provided for illustrative purposes; colors, finishes, screen-printed texts and details of a model may vary according to the manufacturer's batches and the screen used, without this constituting a lack of conformity. The performances announced by the manufacturers (speed, range, power, charging time) are manufacturer values measured under their test conditions and are not guaranteed by Rage Mechanics.
Rage Mechanics may withdraw a Product from sale, modify its price or its characteristics at any time, without effect on orders already accepted.
Article 5. Order
5.1. Process. The Customer adds the Products to their cart, checks the content, enters or confirms their addresses, chooses a delivery method and a payment method, accepts the GTCS and confirms their order by clicking on the button bearing the mention "order with payment obligation". The order is only firm after effective collection of the payment.
5.2. Confirmation. Rage Mechanics sends a confirmation e-mail summarizing the order. It reserves the right to refuse or cancel any order in the event of a manifest price error, unavailability of the Product, previous dispute with the Customer, suspicion of fraud or impossibility to deliver to the indicated address; the sums paid are then refunded, excluding any compensation.
5.3. Accuracy of information. The Customer is solely responsible for the accuracy of the information they provide (identity, delivery address, telephone number, e-mail address, compatibility of the Product with their vehicle). Any return, reshipment, delay or loss resulting from erroneous or incomplete information is at their expense.
5.4. Availability and Made-to-order Products. Availability is indicated on each sheet:
- "In stock": shipment within the preparation time indicated in article 7.
- "Made-to-order": the Product is sourced, manufactured or assembled after payment validation. The time displayed on the sheet is an indicative estimate, calculated from the collection, which depends on the lead times of suppliers and manufacturers; it does not constitute a firm commitment. Rage Mechanics informs the Customer by e-mail of any significant foreseeable delay. A supply delay does not entitle to any compensation.
The Customer may cancel a "made-to-order" order free of charge as long as Rage Mechanics has not initiated the specific supply or started the assembly; they are then refunded within fourteen days. Beyond that, cancellation is no longer possible for Assembled or personalized Products (article 8.3).
5.5. Products assembled at the Customer's request. Certain Products ("Titanium Edition" packs, assembly of performance parts, batteries or motors assembled according to the Customer's instructions) are made by mounting, at the Customer's request, parts manufactured or chosen by Rage Mechanics on a new vehicle or on another Product, replacing original parts. This assembly modifies the vehicle or the part in a lasting way and makes it unmarketable in its original state. These Products are therefore goods made to the Customer's specifications or clearly personalized within the meaning of article L. 221-28, 3° du Code de la consommation. The Customer is informed of this on the product sheet and, before payment, by a specific checkbox whose acceptance is recorded with the order.
Article 6. Price and Payment
6.1. Price. Prices are indicated in euros, all taxes included for deliveries within the European Union, excluding delivery costs, which are displayed in the cart before validation. For deliveries outside the European Union, prices are displayed excluding French VAT. The applicable prices are those displayed at the time of the order. In the event of a manifest price error (derisory price with regard to the value of the Product), Rage Mechanics may cancel the order under the conditions of article 5.2.
6.2. Payment methods. The Customer pays by credit card (secure Stripe payment, including Apple Pay and Google Pay when offered), bank transfer, check, or by the installment payment offered in the cart when the amount and the country of delivery are eligible (offer subject to acceptance by the financing organization, whose conditions are presented at the time of choice). Rage Mechanics has no access to any credit card data. In case of payment by transfer or check, the order is processed and the deadlines only run from the collection; an order not paid within ten days is cancelled.
6.3. Invoicing. The invoice is made available in the customer area in electronic format, which the Customer expressly accepts.
6.4. Late payment (Professional Customers). Any amount unpaid at the due date shall automatically bear late payment penalties at the rate of three times the legal interest rate, as well as a fixed recovery indemnity of €40 per invoice (articles L. 441-10 and D. 441-5 du Code de commerce), without prejudice to the suspension of current orders.
6.5. Retention of title. Rage Mechanics retains ownership of the Products until full payment of the price. The transfer of risks occurs under the conditions of article 7.4.
6.6. Deliveries outside the European Union: duties and taxes. For any delivery outside the European Union (Switzerland, United Kingdom, Norway, Israel, United States, Canada, etc.), customs duties, VAT and import taxes, as well as customs clearance fees charged by the carrier are due by the recipient Customer, in addition to the price, directly to the carrier or the local administration. Their amount depends on the country of destination and is neither known nor controlled by Rage Mechanics. The Customer is responsible for verifying that the Product is admitted for import into their country (lithium batteries, vehicle power). A package refused or unclaimed for non-payment of these fees is, depending on the carrier, destroyed or returned; the costs of return, storage and destruction are deducted from the potential refund, which cannot exceed the value of the Product.
Article 7. Delivery
7.1. Zones and carriers. Rage Mechanics delivers worldwide, subject to the regulations of the country of destination. The available carriers (Chronopost, Colissimo, DHL, UPS, FedEx, DPD, GLS and others, via the Packlink platform), workshop pickup and rates are displayed in the cart according to the address and weight. Rage Mechanics may substitute the chosen carrier with a carrier of equivalent service, at no extra cost to the Customer.
7.2. Lead times. Products in stock are handed over to the carrier within a preparation time of one to three working days from the collection (excluding weekends, public holidays and closing periods announced on the Site). The delivery times indicated in the cart or in the carrier titles ("24h", "3 days") are those announced by the carriers for mainland France; they are indicative, run from the handover to the carrier and may be extended by customs formalities, periods of high activity, strikes, bad weather or any cause external to Rage Mechanics. Made-to-order Products are shipped under the conditions of article 5.4. An order containing Products in stock and Made-to-order Products is shipped in one go, upon availability of the last Product, unless the Customer requests partial shipment (the additional shipping costs are then at their expense).
In the absence of an agreed delivery date, Rage Mechanics delivers no later than thirty days after collection for Products in stock. In accordance with article L. 216-6 du Code de la consommation, in case of exceeding the deadline, the consumer Customer may, after having enjoined Rage Mechanics in writing to deliver within a reasonable additional period and in the absence of delivery within this new period, terminate the order in writing; they are then refunded within fourteen days. The delay in delivery does not entitle to any other compensation or damages.
7.3. Receipt, reservations, damage. The Customer, or the person they designate to receive, checks the condition of the package in the presence of the delivery person before signing. In case of damaged, opened, wet, crushed or incomplete package, they must refuse the package or make handwritten, precise, dated and signed reservations on the delivery note ("package opened", "carton dented on the left side, product scratched"), the mention "subject to unpacking" being worthless. They must notify Rage Mechanics within three working days at contact@rage-mechanics.com, with photos of the outer packaging, the inner padding, the transport label and the Product. These reservations condition the recourse against the carrier; their absence deprives Rage Mechanics of any recourse and the Customer will have to provide proof that the damage occurred before delivery. For the professional Customer, reservations with the carrier under the conditions of article L. 133-3 du Code de commerce are mandatory, under penalty of foreclosure.
A package indicated as "delivered" by the carrier and not received must be reported within three working days; an investigation is opened with the carrier, the duration of which (up to thirty days) suspends any refund or reshipment. The Customer who has authorized delivery without signature, drop-off in a safe place, with a neighbor or in a relay point, or who has modified the delivery directly with the carrier, assumes the risks.
7.4. Transfer of risks. The risk of loss and damage is transferred to the consumer Customer upon physical delivery of the Product to themselves or to the third party they have designated. When the Customer chooses a carrier, a delivery method or a delivery option not offered by Rage Mechanics, or has the delivery modified with the carrier, the risks are transferred to them upon handover to the carrier. For the professional Customer, the risks are transferred upon handover to the carrier.
7.5. Vehicles and Assembled Products. Vehicles and "Titanium Edition" packs are shipped in the manufacturer's original carton; parts mounted in the workshop are fixed and tightened to torque; the handlebars, mirrors and elements dismantled for transport are provided with their screws and instructions and are to be assembled by the Customer, who checks the tightening of all fasteners before the first use and regularly thereafter. No pallet delivery is provided unless prior written agreement and invoicing of the corresponding transport. Lithium batteries are shipped according to the regulations for the transport of dangerous goods, which may limit the carriers and destinations available.
7.6. Workshop pickup. The Customer who chooses pickup is notified by e-mail of the availability and picks up their order by appointment, upon presentation of an identity document and the order confirmation. An order not picked up within thirty days following this e-mail, despite a reminder, is cancelled and refunded, after deduction of the costs incurred for a Made-to-order or Assembled Product.
Article 8. Right of withdrawal, returns and warranties
8.1. Customer service. Customer service can be reached by e-mail at contact@rage-mechanics.com, from Monday to Friday, and by mail at the address in article 1. Rage Mechanics responds within seven working days.
8.2. Right of withdrawal (Consumer Customers). The consumer Customer has a period of fourteen days from receipt of the Product (or the last Product of an order delivered in several parts) to withdraw without reason. They notify their decision before the expiry of the period by the form in the appendix, or by any unambiguous written declaration sent to contact@rage-mechanics.com, indicating the order number. Rage Mechanics acknowledges receipt by e-mail and communicates the return instructions.
The Customer returns the Product, at their expense, no later than fourteen days after their notification, to the address in article 1, complete (accessories, charger, keys, manuals, screws, inner packaging), in its original packaging, in a condition allowing its resale. The costs and risks of the return are at the Customer's expense; for a vehicle or any package exceeding postal standards (more than 30 kg or more than 150 cm), the cost of the return is estimated between €80 and €250 in mainland France depending on the carrier, and more internationally, the Customer having to insure the package for its value. The transport of lithium batteries in return must comply with the applicable regulations; Rage Mechanics may offer a return label whose cost is deducted from the refund.
The Customer's liability is engaged regarding the depreciation of the Product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning. In particular, the following are deducted from the refund, upon proof: the cost of refurbishing a vehicle that has been ridden beyond a test of a few hundred meters (tires, deck, scratches, odometer mileage), a scratched, dirty, wet, disassembled Product, whose films or protections have been removed, or returned without original packaging or with missing accessories; for an electronic part (controller, screen, motor, battery), its connection or powering up makes the Product not resalable as new and leads to depreciation that can reach the entire price.
Rage Mechanics refunds the sums paid, including the initial delivery costs at the cheapest standard rate it offers (the supplements of an express delivery chosen by the Customer are not refunded), no later than fourteen days after receipt of the returned Product or proof of its shipment, by the payment method used during the order.
8.3. Exclusions from the right of withdrawal. In accordance with article L. 221-28 du Code de la consommation, the right of withdrawal cannot be exercised for:
- Products assembled or personalized at the Customer's request (article 5.5): "Titanium Edition" packs, vehicles or parts on which Rage Mechanics has mounted components at the Customer's request, parts machined, painted, anodized or engraved on request, batteries and motors assembled according to the Customer's instructions, specific windings or settings;
- service provisions (assembly, adjustment, repair, diagnosis, update, configuration) fully executed before the end of the withdrawal period, with the Customer's express prior agreement and express waiver of their right of withdrawal;
- digital content (firmwares, licenses, files) whose download or execution has begun with the Customer's express agreement;
- Products unsealed by the Customer that cannot be returned for hygiene or safety reasons: battery cells and packs whose safety packaging has been opened, opened consumables (greases, glues, brake fluids).
For these Products and services, a specific checkbox is presented to the Customer before payment: "I understand that this product is assembled to order or that this service is performed at my request, and that I do not benefit from the 14-day right of withdrawal". The Customer receives a confirmation of this acceptance with their order. Article 5.4 (cancellation before assembly) remains applicable.
8.4. Legal warranties (Consumer Customers). Independently of any commercial warranty, Rage Mechanics is bound by the legal warranty of conformity (articles L. 217-3 to L. 217-20 du Code de la consommation) and the warranty against hidden defects (articles 1641 to 1649 du Code civil).
The consumer has a period of two years from the delivery of the good to obtain the implementation of the legal warranty of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
When the sales contract for the good provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal warranty is applicable to this digital content or this digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity of the digital content or the digital service and not the date of its appearance.
The legal warranty of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the good.
The legal warranty of conformity gives the consumer the right to the repair or replacement of the good within thirty days of their request, at no cost and without major inconvenience to them.
If the good is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests the repair of the good, but the seller imposes the replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the good.
The consumer may obtain a reduction in the purchase price by keeping the good or terminate the contract by being fully refunded against return of the good, if:
- 1° The professional refuses to repair or replace the good;
- 2° The repair or replacement of the good takes place beyond thirty days;
- 3° The repair or replacement of the good causes a major inconvenience to the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming good, or if they bear the costs of installing the repaired good or replacement;
- 4° The lack of conformity of the good persists despite the seller's attempt to bring it into conformity which has remained unsuccessful.
The consumer is also entitled to a price reduction or the termination of the sale when the lack of conformity is so serious that it justifies that the price reduction or the termination of the sale be immediate. The consumer is then not required to request the repair or replacement of the good beforehand.
The consumer is not entitled to the termination of the sale if the lack of conformity is minor.
Any period of immobilization of the good with a view to its repair or replacement suspends the warranty that remained to run until the delivery of the restored good.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 du Code de la consommation.
The seller who in bad faith obstructs the implementation of the legal warranty of conformity is liable to a civil fine of a maximum amount of 300,000 euros, which may be increased up to 10% of the average annual turnover (article L. 241-5 du Code de la consommation).
The consumer also benefits from the legal warranty against hidden defects in application of articles 1641 to 1649 du Code civil, for a period of two years from the discovery of the defect. This warranty entitles to a price reduction if the good is kept or to a full refund against return of the good.
To implement it, the Customer writes to contact@rage-mechanics.com describing the defect, with photos or video and order number; Rage Mechanics organizes the return, the costs of which are at its expense when the lack of conformity is established. Do not constitute a lack of conformity: normal wear and tear, the damages described in article 8.6, the deviations from manufacturer values mentioned in article 4, nor the variations in range linked to temperature, relief, pilot weight, riding style and normal aging of batteries.
8.5. Commercial warranties.
- New vehicles: manufacturer's commercial warranty as defined in its conditions (generally two years on the frame and electrical components, reduced duration on the battery, excluding consumables), implemented by Rage Mechanics as a reseller, subject to the manufacturer's agreement; the deadlines for diagnosis and supply of parts by the manufacturer are suffered by Rage Mechanics and are not attributable to it. The assembly by Rage Mechanics of parts of its manufacture ("Titanium Edition" packs) does not affect the manufacturer's warranty of the components not concerned by the assembly (motors, battery, controllers, brakes, suspensions, lighting); the steering column and the parts mounted by Rage Mechanics are guaranteed by Rage Mechanics under the conditions below.
- Parts designed or manufactured by Rage Mechanics (titanium columns and adapters, stems, motors, controllers, batteries, displays, supports): two-year commercial warranty from delivery against any defect in material or workmanship, by repair or replacement at the choice of Rage Mechanics, labor included at the Lyon workshop, shipping costs to the workshop at the Customer's expense and return costs at the expense of Rage Mechanics if the defect is confirmed. The replacement of a part does not extend the duration of the initial warranty.
- Parts and accessories of other brands: manufacturer's warranty, generally two years, under the conditions of the latter.
- Workshop services: the conformity of the service is guaranteed for six months; the warranty does not cover parts provided by the Customer nor pre-existing defects of the vehicle.
8.6. Exclusions from commercial warranties. Excluded from the commercial warranties of article 8.5 are: normal wear and tear (tires, inner tubes, pads, discs, bearings, seals, cables, handles, grips, battery beyond normal capacity loss); damages resulting from a fall, shock, accident, jump, use in competition or outside the limits of load, speed or terrain indicated by the manufacturer or by Rage Mechanics; immersion, exposure to pressurized water, salt or extreme temperatures; lack of maintenance or tightening checks; assembly, tightening, wiring or configuration not in accordance with the manual or performed by the Customer or a third party; any electrical, mechanical or software modification not performed by Rage Mechanics (unbridling, change of battery, controller or firmware, current increase); non-compliance with battery charging and storage instructions; aesthetic damages not affecting operation; damages resulting from the use of a faulty part after the appearance of the defect. The diagnostic costs of a Product returned under warranty whose defect is not confirmed or falls under an exclusion are invoiced at the workshop rate, as well as the return costs.
8.7. After-sales returns. Any return is preceded by a written agreement from Rage Mechanics assigning a return number. The Product is shipped in suitable packaging, battery charged between 30 and 50%, in accordance with the regulations for the transport of lithium batteries, and insured by the Customer for its value. Products received without prior agreement, insufficiently packaged or unidentified may be refused or stored at the Customer's expense. A Product not claimed six months after informing the Customer of the end of the after-sales service is deemed abandoned.
Article 9. Use of vehicles and performance parts
9.1. Vehicles not approved for public roads. Electric scooters and other devices sold on the Site whose speed by construction exceeds 25 km/h, or whose power exceeds that authorized for motorized personal transport devices, cannot circulate on public roads in France without approval, registration, insurance and regulatory equipment, and are not delivered with these elements. They are sold for use on private or closed land, or in compliance with the legislation of the country of use, which the Customer undertakes to verify and respect. The Customer acknowledges having been informed of these restrictions before the order.
9.2. User responsibility. The use of a high-power electric vehicle presents risks of falls and serious injury. The Customer is solely responsible for the use they make of the vehicle, their driving, wearing a helmet and suitable protective equipment, maintenance and regular tightening checks, the condition of tires and brakes, compliance with load limits and manual instructions, and taking out insurance covering their use. They are prohibited from leaving the vehicle to a minor or a person not trained in its use. To the extent permitted by law, Rage Mechanics is not liable for bodily, material or immaterial damages resulting from the use of the vehicle, its fall, misuse, lack of maintenance or non-compliance with the laws of the country of use.
9.3. Performance parts and modifications. Motors, controllers, batteries, columns and other performance parts modify the characteristics of the original vehicle (speed, acceleration, mechanical stress, range, behavior) and may lead to the loss of the vehicle manufacturer's warranty and its potential approval. Their installation by the Customer or a third party is done under their sole responsibility, following the manuals provided and the rules of the art; the compatibility announced on a product sheet assumes a standard, unmodified vehicle. Rage Mechanics is not liable for damages to the vehicle, other components or persons resulting from assembly, adjustment, wiring or configuration not performed by it, nor for the association of its parts with third-party components (batteries, controllers, firmwares) whose compatibility it has not validated.
9.4. Batteries. Lithium batteries must be charged with the charger provided or validated by Rage Mechanics, under supervision, in a dry, ventilated place away from flammable materials, never after a shock, immersion or deformation. The Customer is responsible for the storage, charging, transport and recycling of batteries in compliance with regulations.
Article 10. Liability of Rage Mechanics
10.1. Rage Mechanics is bound by an obligation of means for the services and information provided on the Site (compatibility advice, guides, manuals, technical content), which are given for information purposes without guarantee of completeness; the Customer verifies the compatibility of a Product with their vehicle before the order, if necessary by asking customer service.
10.2. To the extent permitted by law and without prejudice to the legal warranties and public policy provisions protecting the consumer, the liability of Rage Mechanics is limited to direct, personal and certain damages, and cannot exceed the amount of the order concerned. Rage Mechanics is not liable for indirect damages (loss of enjoyment, immobilization, replacement rental costs, loss of earnings or turnover, data loss) nor for damages resulting from a fault of the Customer, a third party or a case of force majeure.
10.3. Force majeure. Constitute cases of force majeure or exonerating causes events beyond the reasonable control of Rage Mechanics, in particular: strikes or failures of carriers, postal services, customs or suppliers; delays, shortages or supply stops from manufacturers; component shortages; bad weather, floods, fires, epidemics and administrative measures; wars, embargoes, sanctions; failures of telecommunication, payment or hosting networks; cyberattacks. The obligations of Rage Mechanics are suspended for the duration of the event; if it lasts more than sixty days, each party may cancel the order, the sums paid being refunded excluding any compensation.
10.4. Site. Rage Mechanics does not guarantee uninterrupted access to the Site and is not liable for interruptions, errors, viruses or content of third-party sites accessible via hyperlink. The information on the Site may contain errors or omissions; Rage Mechanics corrects them as soon as it becomes aware of them without this engaging its liability.
Article 11. Professional Customers
Resellers and professionals with a validated account in the reseller area, as well as any Customer acting for professional purposes, are subject to these GTCS with the exception of provisions specific to consumers (articles 7.2 second paragraph, 7.4 first sentence, 8.2 to 8.4, 12.3 mediation), which are not applicable to them. The reservations upon delivery of article 7.3 are enforceable against them (articles L. 133-3 and following of the Code de commerce), the commercial warranties of article 8.5 apply with round-trip transport at their expense, and the warranty against hidden defects is limited to the replacement or refund of the defective part, excluding any other damage. The specific pricing, payment and delivery conditions are those indicated in the reseller area or agreed in writing.
Article 12. Personal data
12.1. Data controller. SAS Rage Mechanics, 34 rue des Remparts d'Ainay, 69002 Lyon, contact@rage-mechanics.com, represented by its president. Rage Mechanics has not appointed a data protection officer; any request relating to personal data is sent to contact@rage-mechanics.com (subject "Personal data").
12.2. Data and purposes. Rage Mechanics collects the data necessary for account creation, order processing, delivery, invoicing, after-sales service, warranty management, fraud prevention, compliance with its legal obligations (accounting, fraud prevention) and, with the Customer's agreement, sending commercial information: identity, postal details, e-mail, telephone, order history, exchanges with customer service, navigation data (cookies, see privacy policy). The legal bases are the execution of the contract, compliance with legal obligations, the legitimate interest of Rage Mechanics (fraud prevention, site improvement) and consent (prospecting, non-essential cookies).
12.3. Recipients and transfers. The data is processed by Rage Mechanics and by its subcontractors for the sole purposes above: hosting (OVH, France), payment (Stripe, PayPal, PayPlug; financing institution for installment payment), shipping (Packlink and the chosen carriers), commercial management and invoicing (Axonaut, France), transactional e-mails, internal notifications, audience measurement and advertising (Google, Meta) with the Customer's consent. Some of these providers are located outside the European Union, particularly in the United States; transfers are governed by standard contractual clauses adopted by the European Commission and, where applicable, by the EU–US Data Privacy Framework when the provider is certified there. For deliveries outside the European Union, the data necessary for transport and customs clearance is transmitted to the carrier and the authorities of the country of destination. Data may be communicated upon requisition by an authority or court decision, or transmitted to the buyer in the event of a business sale.
12.4. Retention periods. Account and order data are kept for the duration of the commercial relationship and then for the legal limitation periods (ten years for accounting documents, five years for contracts), prospecting data three years after the last contact, navigation data thirteen months at most.
12.5. Rights. The Customer has the rights of access, rectification, erasure, limitation, opposition and portability of their data, the right to withdraw their consent at any time and the right to define directives on the fate of their data after their death, by writing to contact@rage-mechanics.com, accompanied by proof of identity in case of reasonable doubt. Rage Mechanics responds within one month. The Customer may file a complaint with the CNIL (www.cnil.fr). They can register on the Bloctel telephone solicitation opposition list (www.bloctel.gouv.fr).
Article 13. Personal account
Account creation is necessary to order. The Customer chooses a password that they keep confidential and is responsible for any use of their account. They keep their information up to date. Rage Mechanics may suspend or delete the account of a Customer who provides inaccurate information, contravenes the GTCS, uses robots or automated queries on the Site, or whose account has been inactive for more than three years, without this entitling to compensation. The information in the personal area is provided for convenience; only Rage Mechanics' records are authentic.
Article 14. Intellectual property
The Site, its structure, its texts, photographs, videos, drawings, plans, technical sheets, software, firmwares, brands and logos, as well as the designs of Rage Mechanics parts, are protected by copyright, trademark law, design law and database law. Any reproduction, representation, adaptation, reverse engineering, copying or distribution, total or partial, without written authorization from Rage Mechanics is prohibited and constitutes an infringement. The sale of a Product confers no right to the Customer on the embedded software and firmwares, which remain the property of Rage Mechanics or their publishers and are licensed for non-exclusive use for the use of the Product.
Article 15. Final provisions
15.1. Applicable law and language. The GTCS and sales concluded on the Site are subject to French law, subject to mandatory provisions more favorable to the country of residence of the consumer Customer of the European Union. They are written in French; in case of translation, only the French version is authentic.
15.2. Complaints and mediation. Any complaint is addressed first to customer service (article 8.1), which seeks an amicable solution. The consumer Customer may also resort, within one year from their written complaint to Rage Mechanics, to the European online dispute resolution platform (https://ec.europa.eu/consumers/odr) and, once designated, to the consumer mediator to which Rage Mechanics belongs, whose contact details will be indicated here and in the legal notices.
15.3. Jurisdiction. In the absence of an amicable agreement, disputes are brought before the competent French courts. For professional Customers, exclusive jurisdiction is assigned to the Commercial Court of Lyon, including in the event of summary proceedings, warranty claims or plurality of defendants.
15.4. Miscellaneous. If a clause of the GTCS is declared null or unenforceable, the other clauses remain in force and the clause concerned is replaced by a valid clause of equivalent effect. The fact that Rage Mechanics does not avail itself of a breach by the Customer does not constitute a waiver to avail itself of it later. Rage Mechanics archives orders and invoices on a reliable and durable medium constituting a faithful copy.
